These Terms govern your use of the SmartCardPro Platform.


1. Introduction


These Terms of Use (“Terms”) govern your access to and use of the SmartCardPro platform, website, applications, dashboards, and related services (collectively, the “Platform”).


The Platform is operated by:

By accessing or using the Platform, you agree to be bound by these Terms.


2. Our Role


SmartCardPro is a technology platform that enables approved businesses and platforms (“Platforms”) to distribute payouts to their affiliates, creators, contractors, and service providers (“Users”). SmartCardPro:


  • Provides software, dashboards, APIs, and user interfaces
  • Facilitates payout workflows between Platforms and Users
  • Does not provide banking, e-money, or money transmission services

SmartCardPro is not a bank, not a card issuer, and does not hold customer funds as a regulated deposit-taking institution. All regulated financial services are provided by licensed financial institutions and programme partners under their own terms and conditions.


3. Eligibility


You may use the Platform only if:


  • You are invited, approved, or onboarded by a participating Platform
  • You successfully complete required verification checks, including identity verification (KYC), sanctions screening, and other compliance checks

Availability of services depends on programme rules, regulatory requirements, and country or jurisdictional restrictions.


4. User Accounts


Users receive access to SmartCardPro primarily to receive payouts from approved Platforms they work with. Subject to programme rules, SmartCardPro may also support limited digital asset funding features where enabled. Such features are optional, programme-specific, may require additional verification, and do not constitute deposit-taking by SmartCardPro.


SmartCardPro may suspend or restrict access where required by compliance, risk, or partner obligations.


5. Payouts and Funds Flow


  • All fiat payouts originate from Platforms or approved funding sources
  • SmartCardPro does not guarantee payout timing or availability
  • Processing times depend on verification status, partner systems, and programme rules

Users acknowledge that fees, FX rates, limits, and availability are set by Platforms and/or regulated partners. Transactions may be delayed, reversed, or declined for compliance, fraud, or regulatory reasons.


6. Cards and Wallets


  • Cards and wallets (where available) are issued and operated by licensed financial institutions
  • They are subject to separate cardholder and programme terms
  • They may be virtual or physical depending on eligibility

SmartCardPro does not control card network acceptance, merchant restrictions, or third-party service availability.


7. Prohibited Use


You may not use the Platform to:


  • Engage in illegal, fraudulent, or deceptive activities
  • Circumvent sanctions, AML, or compliance requirements
  • Use funds for restricted or prohibited activities under programme rules
  • Provide false, misleading, or incomplete information

8. Suspension and Termination


SmartCardPro may suspend or terminate access, without prior notice, where required by:


  • Applicable law or regulation
  • Instructions from programme partners or issuers
  • Risk, security, or compliance concerns

Termination may result in loss of access to the Platform. Any remaining balances will be handled in accordance with partner and regulatory requirements.


9. Intellectual Property


All Platform content, software, branding, trademarks, and materials are owned by or licensed to SmartCardPro. You may not copy, modify, distribute, or reverse-engineer any part of the Platform without written permission.


10. Disclaimers


The Platform is provided on an “as is” and “as available” basis. SmartCardPro makes no guarantees regarding availability or uptime, payout timing, card acceptance, or suitability for any particular purpose.


11. Limitation of Liability


To the maximum extent permitted by law, SmartCardPro shall not be liable for delays or failures caused by Platforms, partners, or third-party providers, compliance-related account actions, or indirect, incidental, or consequential losses.


12. Governing Law and Jurisdiction


These Terms are governed by and construed in accordance with the laws of Hong Kong. Any disputes shall be subject to the exclusive jurisdiction of the courts of Hong Kong.
